Terms and Conditions

These Terms and Conditions (“Agreement”) are entered into by and between Heartwise Development Services Inc. ("Practitioner") and the individual ("Client") requesting a “Reading” described in the “Services” section. By signing this Agreement, Client agrees to the following terms and conditions:

1. Description of Services

Practitioner provides psychic and/or intuitive Readings, delivered as intuitive insights and interpretations.

·       Session length: Readings are scheduled for 45 minutes in length

·       Delivery method: Readings are given via live, virtual session over Zoom, unless arranged otherwise in writing between Practitioner and Client.

·       Services are experiential, interpretive, and intuitive in nature

·       No guarantees are made regarding accuracy, outcomes, or results

2. Spiritual & Entertainment Disclaimer

Client understands and agrees that:

  • Psychic/intuitive readings are subjective and based on Practitioner’s intuitive perceptions at the time of the session.

  • Services are provided for personal insight, reflection, and spiritual exploration purposes only.

  • Services are not a substitute for professional advice, including but not limited to medical, mental health, legal, financial, or business advice.

To the fullest extent permitted by law, services are offered as spiritual guidance and/or entertainment.

3. No Professional Relationship

No therapist-client, doctor-patient, attorney-client, fiduciary, or other relationship is created by this Agreement or by participation in services.

Practitioner does not diagnose conditions, prescribe treatment, or provide professional counsel.

4. Attendance and Scheduling

·       Rescheduling: Client shall inform Practitioner no less than 48 hours in advance of their scheduled Reading if they need to reschedule. Cancellations made fewer than 48 hours before a scheduled Reading are not eligible for a refund or rescheduling.

·       Refunds and Cancellations: Client shall not be entitled to refunds or cancellations arising from Client’s failure to show up to their Reading or deciding they no longer want a Reading. No refunds are issued once services are rendered. Practitioner reserves the right to cancel sessions, with reasonable notice to Client. If Practitioner cancels a session, alternative times will be offered as soon as possible. If Practitioner cannot reschedule, a refund will be issued.

·       Tardy Policy: If Client is more than 10 minutes late to their Reading, it will be considered a “no show”.

5. Client Responsibilities

·       Participation: Client is expected to actively participate in a conversation to discover meaning and determine application to their life.

·       Distractions: Client is expected to remove distractions during sessions, including but not limited to closing other windows or tabs and putting phones on silent and out of sight, as they can disturb Practitioner’s ability to perceive or interpret.

·       Professional Behavior: Clients must act respectfully, professionally, reflectively, and introspectively. Clients must refrain from harassment, abuse, or other inappropriate behavior. For any such conduct, Practitioner reserves the right to terminate a Reading without a refund, in Practitioner’s sole and absolute discretion.

6. Assumption of Risk

Client acknowledges that:

·       Client is solely responsible for how they interpret and apply any information shared during a session.

·       Client retains full responsibility for their decisions, actions, and outcomes.

·       Intuitive insights are one perspective, not facts or directives.

Client voluntarily assumes all risks associated with participation.

7. Mental Health and Crisis Disclaimer

By agreeing to this Agreement, Client represents that they are in a mental and emotional state suitable for receiving intuitive services. Client acknowledges that these services are not a substitute for professional mental health care and agrees to seek appropriate professional support if needed. Practitioner reserves the right to decline or discontinue a Reading if, in Practitioner’s reasonable judgment, the service is not appropriate for Client at that time.

Specifically, Services are not appropriate for individuals who are experiencing:

·       Active psychosis

·       Severe mental health crises

·       Suicidal ideation

Practitioner does not provide crisis support. If Client is in distress, they agree to seek immediate help from licensed professionals or emergency services.

8. Technology Disclaimer

Practitioner is not responsible for internet disruptions, Zoom outages, Client’s technical failures, and the like. Should any of these disrupt a Reading, Practitioner will make all reasonable attempts to make contact and complete the Reading.

9. Recording & Intellectual Property

  • Sessions may not be recorded by Client without express written permission.

  • All content, language, frameworks, and materials shared by Practitioner remain Practitioner’s intellectual property.

  • Client may not reproduce, distribute, or commercialize session content.

  • Any violation of this policy will result in immediate termination of this Agreement. Practitioner reserves all rights and remedies available at law and in equity with respect to Practitioner’s intellectual property.

10. Confidentiality. Practitioner may share general insights, anecdotes, or case studies from the Reading, provided no identifiable Client information is disclosed. Exceptions include legal requirements and risk of harm to Client or others.

11. Liability

·       Practitioner is not liable for financial losses, emotional discomfort, or other consequences arising from participation in the Reading.

·       Practitioner shall not be liable for any direct, indirect, incidental, consequential, emotional, or financial damages arising from services.

·       Practitioner’s total liability shall not exceed the amount paid for the session.

12. Indemnification

Client agrees to indemnify and hold harmless Practitioner from any claims, damages, or expenses arising from Client’s use or interpretation of services.

13. Dispute Resolution

·       In the event of a dispute, Client and Practitioner agree to engage in a good-faith conversation to resolve the issue before pursuing legal action.

·       Any legal action will be governed by the laws of the State of Illinois and brought in the Circuit Court of McHenry County, Illinois.

·       Client agrees to reimburse Practitioner’s reasonable attorney’s fees, filing fees, and court costs expended in enforcing this Agreement

·       The failure of Practitioner to enforce any provision of this Agreement shall not constitute a waiver of Practitioner’s right to enforce that provision or any other provision in the future.

14. Entire Agreement. This Agreement represents the entire agreement between the parties and supersedes any prior agreements, promises, conditions, or understandings between Client and Practitioner.  If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

15. Acknowledgment and Agreement. By checking the box, Client acknowledges that they have read, understood, and agree to the terms of this Agreement.
